All transactions between the Q-rious Music Online-Shop at http://www.taketina.com (here in after Q-rious) and its customers are
subject to the conditions set out on this page; for use of this website the
terms specified in our disclaimer apply. By visiting qrious.de you are
accepting and consenting to the terms and practises described in this
document. Any agreement exceeding or altering the terms specified on these
pages requires written confirmation.
Pricing:
All prices include VAT.
Mispricing does not obligate Q-rious to deliver the mispriced goods for the
wrongly specified price.
Shipping and handling are covered by a flat fee which will be displayed by
the shop system during processing of the individual order.
Conclusion of contract is established when a confirmation of the order
placed is eMailed by the Shop-System to the customer; said confirmation is
sent simultaneously to Q-rious so that the actual point of time of the order
placed is documented. Determining the beginning of contract are date and
time of the eMailed confirmation.
Payment terms and customs:
Currently only payment via PayPal is possible for international
transactions. Regulations for delay(ed payment) are therefore not necessary
at the time.
Goods ordered remain property of Q-rious until fully payed for.
Orders from countries outside Germany may be subject to import duties and
taxes levied at destination of goods ordered; any additional charges for
customs clearance must be borne by the customer, Q-rious has no control over
these charges and cannot predict what they may be. Please note that when
ordering from Q-rious, you are considered the importer of record and must
comply with all laws and regulations of the country in which you are
receiving the goods.
Delivery:
Good(s) ordered will be delivered as soon as possible.
Fixed dates of delivery require our written confirmation.
Partial delivery is permitted, subsequent delivery not provided.
Minor change(s) of items reserved.
Risk of accidental loss, deterioration or damage is passed onto the customer
when goods ordered are handed over to the shipping enterprise or its
representant(s) or have left our warehouse for delivery by other means. Same
applies for partial delivery.
If the customer fails to take delivery at address specified with order
placed, goods ordered are considered delivered and payable regardless.
Compensation:
Maximum extent of compansation for failure of fulfilment on part of Q-rious
is the price of good(s) or service(s) ordered.
Force Majeure and other disturbance(s) of delivery or service not caused by
Q-rious absolve Q-rious from duty of delivery.
Privacy and applicable law:
German law applies, expressly Bundesdatenschutzgesetz (BDSG) and the
regulations of Articles 1 and 2 of the german Informations- und
Kommunikationsdienste-Gesetzes (IuKDG) in current version/s.
When placing an order at Q-rious, personal information of the ordering
customer (like name, address, country and the like) are inquired and stored
to enable proper processing of the order and delivery of the good(s)
ordered.
Therefore the customer accepts storage of the inquired personal information
with his order(s). Where Q-rious employs third parties for fulfilment of
orders placed the customer consents forwarding of the necessary personal
information to such parties for proper fulfilment.
Any disclosure of the customer's personal data to parties not involved in
fulfilling the customer's order(s) is barred, as is disclosure to third
parties for market research, marketing or advertising purposes.
Since data is only inquired and stored for the purposes outlined above
specific right of objection is not required.
The customer is (according to § 19 BDSG) entitled to gain insight into the
data stored about his or her own person, on explicit and written demand
filed to Q-rious.
The customer is (according to § 20 BDSG) entitled to demand correction,
deletion or discontinued use of the data stored about his or her own person;
Q-rious will process personal information as desired on written request.
Q-rious assumes that a customer wants to remain approachable after
processing of an order (for inquiries or relating offers by Q-rious); the
customer expressly consents storage of contact information for these
purposes.
Nullity of individual clauses of these terms does not impair validity of the
remaining clauses of these terms.
